Terms of Use

1. Who we are

YGOverlay is supplied and licensed by REALTIME COMÉRCIO DE SOFTWARE LTDA, registered in Brazil under CNPJ no. 12.043.987/0001-00. YGOverlay is the brand the product is presented under. By installing, activating or using YGOverlay you agree to these Terms. If you disagree with any part of them, do not use the product.

These Terms apply to every version of YGOverlay we distribute, including test and pre release builds, and to the official site ygoverlay.com.

2. What YGOverlay is

YGOverlay is a Windows application that shows a panel over the game with the fusion options available from the player's hand in Yu-Gi-Oh! Forbidden Memories and in mods built on that game. It is an independent product.

What you buy is the YGOverlay installer for Windows and a personal use licence. Nothing else is included:

• a)YGOverlay does not include, distribute or host ROMs, ISOs, the original game, mods or official assets.
• b)You need to own the copy of the game, the emulator and any mods you want to use yourself.
• c)Game and mod names appear only to state technical compatibility.

3. Compatibility

YGOverlay is compatible with Windows, with versions 1.8.0, 2.0.5 and 2.0.18 of the ePSXe emulator, and with the Forbidden Legacy PC port. We do not claim compatibility with any other ePSXe version, with other emulators or with other operating systems.

Compatibility is a purchase requirement, not a promise that the product will work on any setup. Check the list above before buying. If your setup is not described there, it is not supported yet.

4. What the licence allows

The licence is personal, non transferable and represented by a single key. It belongs to the buyer and carries the offer purchased, the current status and the activation limit. The licence grants the right to use YGOverlay; it does not transfer ownership of the software or any right over the code.

• a)You may not resell, sublicense, rent, lend or share your licence key.
• b)You may not attempt to bypass activation, modify the application or redistribute an altered installer.
• c)Two activations do not mean two users, nor a family or team licence.
• d)The licence may be revoked in the event of a refund or a confirmed chargeback.

If your key is compromised, write to the official support channel. Only support can replace a key: the previous one is revoked and every activation bound to it is ended.

5. Activation and devices

Using YGOverlay requires activating the licence. Each licence allows at most 2 live activations at the same time, on devices you control. Deactivating a device frees the slot immediately, with no initial waiting period, and you can do it yourself.

A device is a computer identified by a signature that tolerates minor hardware changes. Reinstalling the operating system or swapping components may make it count as a new device; the limit of 2 activations and self service deactivation exist to absorb that.

The application revalidates the licence with the server every time it opens with an internet connection. Between revalidations, offline use is allowed for up to 30 days. The server is the source of truth about the state of the licence.

6. Payment and tax

Payments are processed by Paddle, acting as Merchant of Record. Paddle is the party that sells the licence to the end customer and is responsible for billing, applicable taxes and issuing the receipt. REALTIME supplies and licenses the software.

The Fusion Assistant is a one-time purchase. It permanently includes access to that module, fixes and ongoing compatibility with supported mods. New modules and independent features are not included and may have separate offers in the future, including subscriptions. There is no free plan and no trial period.

As of this version, sales are not open and no licence has been sold.

7. Refunds

You can request a full refund within 14 days of purchasing the Fusion Assistant, with no need to give a reason. That period matches the right of withdrawal for distance contracts set out in Directive 2011/83/EU and, in the United Kingdom, in the Consumer Contracts Regulations 2013. Paddle, as Merchant of Record, determines which withdrawal law applies to your purchase based on the billing country; if the law of your country of residence grants a longer period, the longer period applies.

A request received by the official support channel within the period preserves your right even if it is processed later.

8. Revoking the licence

A refund or a confirmed chargeback revokes the licence immediately on the server. Revocation blocks new activations and ends use at the next revalidation. If the application is offline, access already authorised lasts only until it expires, with no additional grace period.

We may also revoke the licence for breach of these Terms, in particular sharing the key, attempting to bypass activation or fraudulent use of the payment method.

9. Updates and availability

YGOverlay checks for updates when it opens and installs them outside a duel. We publish releases on a single public channel. We may change, suspend or discontinue features, including because of changes in third party software outside our control.

The product is provided as is. We do not guarantee uninterrupted operation, freedom from errors, or compatibility with future versions of emulators, operating systems or mods.

10. Intellectual property and independence

YGOverlay, its brand, its code and its materials belong to REALTIME. These Terms grant no right over them beyond the use described in clause 4.

YGOverlay is an independent product, with no affiliation with, sponsorship by or approval from Konami or the creators of the mods mentioned. Yu-Gi-Oh! and Forbidden Memories are trademarks of their respective owners.

11. Limitation of liability

To the fullest extent permitted by applicable law, our liability for any matter related to YGOverlay is limited to the amount you actually paid in the 12 months preceding the event. Nothing in this clause excludes rights that applicable consumer law does not allow to be excluded.

12. Changes to these Terms

We may update these Terms to reflect changes in the product, in our commercial operation or in the law. The date of the last update appears at the top of this page. Changes that matter to existing customers are announced by email.

13. Governing law and contact

These Terms are governed by Brazilian law, without prejudice to the consumer protection rules of your country of residence.
